James Swan (27 year old) rage against his mother after being asked to quiet down while playing World of Warcraft.
The whole ordeal began when his mother asked him to stop playing as her three grandchildren was going to bed already, Swan who had been drinking started the assault when his mother place her hand on his shoulder. His mother tried to call the police using the kitchen phone but the attempt was ruined when Swan tear the phone from the wall, Swan's grandfather (the mother's father) later came in to help stop Swan, but to no avail. He then went to get the gun out of the closet and misfired during the struggle. The bullet grazed Swan behind his left ear.
Swan was sent to Bayfront Medical Centre, he was later returned to Manatee County and was being held without bond at the county jail on charges of domestic battery by strangulation, child abuse, and felony tampering.

Although Swan did tried to strangulate his mother by choking her, but I wonder how was he charged under child abuse, is it for not letting the children to go to sleep?
